The University of Florida Levin College of Law Institute for Dispute Resolution is pleased to present Cynthia Alkon, Professor of Law and Director of Criminal Law, Justice & Policy Program, Texas A&M University School of Law. She will present Disposing of Misdemeanors: An Empirical Perspective. Professor Alkon will present new data collected under New York’s 2020 bail reform law that provides a more detailed look at criminal case processing than has previously been possible. This data reveals that misdemeanor case processing is more a system of dismissals, then one of plea bargaining. In New York state nearly 60% of all misdemeanor cases are dismissed and depending on the county, it is up to 73% of all misdemeanors filed. This data raises serious questions about plea bargaining and the role of prosecutors, including the need for better prosecutorial screening to avoid unnecessarily exposing thousands of individuals to criminal charges. The findings presented here have implications not only for New York but also for broader criminal legal system reform efforts across the United States.
